Why do we have such laws?

India is a country where the destruction of non-vegetarian food is against the religious practices of some people. Some people utilize only vegetarian food as per their preference. To defend the interests and sentiments of a majority of the population, it has been mandated for all food manufacturers to implement a symbol that determines whether the food is vegetarian and non-vegetarian.

For the meaning of food, refer to Section 3(j) of the Food Safety and Standard Act, 2006.[1]This implies that food means an article that we consume and is essential in natural and passionate development.

Therefore, we can say that toothpaste is not food because it is not employed and is only a part of cleanliness, but it has a vegetarian symbol. This is because earlier grounds of osseins were used as an ingredient in toothpaste production, which is non-vegetarian. This same is not used now because part of the population consists of orders like Brahmins, Jains, and others who favor not having any non-vegetarian article to start their mouth.

Organization for veg and non-veg symbol

The Food Safety and Standards Authority of India (FSSAI) has been established under Food Safety and Standards, 2006, consolidating different Acts & Orders that have hitherto handled food-related issues in other Ministries and Departments.

FSSAI, in its Food Safety and Standards (Packaging and Labeling Regulations, 2011), has created it mandatory for all the food businesses to must symbols that describe whether the food is vegetarian or non-vegetarian.

Food Safety and Standards (Packaging and Labeling) Regulation] in 2011, Section 92 and Section 23 of The Food Safety and Standards Act, 2006, India’s Food Safety and Standards Authority intend to make Food Safety and Standards Regulations so far they describe to Food Safety and Standards (Packaging and Labeling) Regulations, 2011[2]. It became inside force on 5th August 2011.

Regulation 2.2.2(4) of the Food Safety and Standards Act, 2006 discusses veg and non-veg. Notwithstanding the passing of the Act in 2006, some food products did not contain the symbol. Thus, Food Safety and Standards (Packaging and Labeling) Regulations, 2011, were transferred to give a mandatory status to the emblem. The below-given law is laid feather in Regulation 2.2.2(4).

1. Every “Non-vegetarian” food package shall bear a declaration to this conclusion made by a symbol and color code as stipulated below to indicate that the commodity is Non-Vegetarian Food. The symbol shall be brown.
2. Where various food articles contain egg only as a Non-Vegetarian ingredient, the manufacturer, packer, or seller may declare this conclusion in addition to the said symbol.
3. Every combination of Vegetarian Food shall bear a declaration to this impression by a symbol and color code as stipulated for this purpose to show that the product is Vegetarian Food. The symbol shall be of green color.
4. The symbol shall be prominently displayed.
   1. on the package should be a contrasting experience on the principal display panel;
   2. just like in nearness to the name or brand name of the product;
   3. On the labels, vessels, pamphlets, leaflets, and advertisements in any media.

What exactly is veg or non-veg?

“Non-vegetarian Food” suggests an article of food containing whole or part of any animal, including birds, freshwater, marine animals, or eggs or products of any animal origin, but eliminating milk or milk products as an ingredient. “Vegetarian Food” indicates any article on Food other than Non- Vegetarian Food.

Right to Information

A customer has a right to information on the goods and services being sold to him. It suggests it should inform him about all the details of the goods and services. If a consumer utilizes a product and bears any injury due to a lack of knowledge, then the consumer can register a case against the food manufacturer or the seller to counterpoise for the loss in the Consumer Redressal Forum.

But if the food protection inspector in the FSSAI finds any regulation is not supported or gets information that any seller or manufacturer does wrong under any rule, then FSSAI can take Suo moto action.

The same can be done by a person who unknowingly consumes a non-vegetarian food commodity with no symbol. He could file a complaint against the food manufacturer and the seller if the seller claimed that the food goods were vegetarian.

Can do this for the imported goods because according to Regulation 2.2.2(11) of the Food Safety and Standards Act,2006; India is now the beginning of the food.

The consumer can file a case under Section 405 of the Indian Penal Code[5], which presents a criminal breach of trust.

The case for not having a symbol or wrongful representation of the character comes under Section 405 because, firstly, the consumer has shown trust over the seller and the manufacturer. Secondly, it is illegal in creation because the person may experience an injury or have been caused mental damage by consuming non-veg food.

Why has changed the non-veg logo?

The color-coded display has been under consideration for some time. FSSAI has also transformed the symbol of non-vegetarian food from a brown circle to a brown triangle to help color-blind people separate it from the brown, denoting non-vegetarian food. Many color blind people think they are purchasing green logo products but unknowingly get brown logo products because of color blindness. This triangle will help quickly identify the product, which one is veg or non-veg. The shape from a circle to a triangle will get an immediate classification.
